1. Company Information
Summit Slopes Transportation is operated by:
DC3 Distribution LLC
DBA Summit Slopes Transportation
Owner: Steve Raguskus
The Company provides private transportation reservation, coordination, dispatch, and transportation management services throughout Utah and surrounding areas.
2. Reservation Acceptance
All reservations are subject to availability and acceptance by Summit Slopes Transportation.
We reserve the right to decline, modify, or cancel any reservation due to:
- Weather conditions
- Road closures
- Vehicle availability
- Safety concerns
- Passenger misconduct
- Force majeure events
- Circumstances beyond our reasonable control
3. Rates and Payment
All rates are quoted in U.S. Dollars.
Unless otherwise stated:
- Rates may include airport fees, applicable taxes, and gratuity.
- Additional charges may apply for extended wait times, additional stops, route deviations, holiday service, excessive luggage, cleaning fees, vehicle damage, or special requests.
- Full payment may be required prior to service.
- Corporate accounts may be invoiced according to approved account terms.
Summit Slopes reserves the right to modify rates at any time.
4. Cancellation Policy
Unless otherwise stated in a separate agreement:
Airport Transfers:
- Cancellations made more than 24 hours prior to scheduled pickup may receive a full refund.
- Cancellations made within 24 hours of pickup may be charged up to the full reservation amount.
Hourly Charters:
- Cancellations within 72 hours of service may be charged up to the full reservation amount.
Special Events, Holidays, and Peak Demand Dates:
- Reservations may be non-refundable.
No-shows may be charged the full reservation amount.
5. Wait Time Policy
Complimentary wait time may be provided at the Company's discretion.
Additional waiting time beyond the complimentary period may result in additional charges.
Passengers are responsible for maintaining communication regarding delays.
6. Passenger Conduct
Passengers shall:
- Comply with all applicable laws.
- Follow driver instructions.
- Wear seat belts when available.
- Refrain from illegal drug use.
- Refrain from smoking or vaping inside vehicles.
- Avoid conduct that may endanger the driver, vehicle, or other passengers.
The Company reserves the right to terminate service without refund if passenger conduct threatens safety or damages property.
7. Property Damage and Cleaning Fees
Passengers are financially responsible for any damage caused to a vehicle by themselves, their guests, or members of their party.
Additional charges may be assessed for:
- Excessive cleaning
- Vomit or bodily fluid cleanup
- Interior damage
- Exterior damage
- Burns
- Broken components
- Lost equipment
Charges will be based upon actual repair, replacement, or cleaning costs.
8. Lost and Found
Summit Slopes Transportation is not responsible for items left in vehicles.
Reasonable efforts will be made to return recovered property; however, no guarantee is made regarding recovery.
Shipping and handling expenses are the responsibility of the passenger.
9. Weather, Road Conditions, and Delays
Travel times are estimates only.
Summit Slopes Transportation shall not be liable for delays resulting from:
- Weather
- Traffic
- Road conditions
- Accidents
- Construction
- Airport delays
- Government actions
- Mechanical failures
- Events outside the Company's reasonable control
No guarantee is made regarding arrival times.
Passengers are encouraged to schedule transportation with reasonable time allowances.
10. Independent Affiliate Operators
To meet transportation demand and provide service flexibility, Summit Slopes Transportation may arrange transportation through independent affiliate transportation providers and drivers.
Such affiliate operators:
- Are independent businesses and/or independent contractors.
- Are not employees of DC3 Distribution LLC.
- Maintain their own licenses, permits, and insurance coverage.
- Are independently responsible for operating their vehicles.
- Must satisfy applicable insurance requirements established by Salt Lake City International Airport and other applicable regulatory authorities.
The use of an affiliate transportation provider constitutes acceptance of transportation services from an independent transportation operator.
11. Release of Liability for Affiliate Operators
TO THE FULLEST EXTENT PERMITTED BY LAW, THE CLIENT, PASSENGER, AND ALL MEMBERS OF THE PASSENGER'S PARTY AGREE TO RELEASE, DEFEND, INDEMNIFY, AND HOLD HARMLESS:
- DC3 Distribution LLC;
- Summit Slopes Transportation;
- Steve Raguskus;
- Their officers, owners, members, managers, employees, agents, and representatives;
from any and all claims, liabilities, demands, actions, lawsuits, damages, losses, expenses, costs, attorney fees, judgments, or causes of action arising out of or relating to:
- The acts or omissions of an independent affiliate driver;
- Vehicle accidents;
- Personal injury;
- Property damage;
- Delays;
- Transportation interruptions;
- Conduct of independent affiliate operators;
- Claims arising during transportation services provided by an affiliate operator.
The Client acknowledges that transportation services may be performed by independent transportation providers over whom Summit Slopes Transportation does not exercise day-to-day operational control.
12. General Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DC3 DISTRIBUTION LLC, SUMMIT SLOPES TRANSPORTATION, AND STEVE RAGUSKUS SHALL NOT BE LIABLE FOR ANY:
- INDIRECT DAMAGES;
- INCIDENTAL DAMAGES;
- CONSEQUENTIAL DAMAGES;
- SPECIAL DAMAGES;
- PUNITIVE DAMAGES;
- LOST PROFITS;
- LOST BUSINESS OPPORTUNITIES;
- MISSED FLIGHTS;
- MISSED EVENTS;
- MISSED CONNECTIONS;
- EMOTIONAL DISTRESS CLAIMS;
ARISING OUT OF OR RELATED TO THE USE OF SERVICES PROVIDED BY SUMMIT SLOPES TRANSPORTATION.
Any liability that cannot legally be excluded shall be limited to the amount paid for the transportation service giving rise to the claim.
13. Assumption of Transportation Risks
Passenger acknowledges that transportation by motor vehicle inherently involves risks, including:
- Vehicle accidents
- Road hazards
- Weather conditions
- Mechanical failures
- Actions of third parties
By utilizing transportation services, Passenger voluntarily assumes all ordinary risks associated with ground transportation.
14. Indemnification
Client agrees to defend, indemnify, and hold harmless DC3 Distribution LLC, Summit Slopes Transportation, and Steve Raguskus from claims, liabilities, damages, costs, and expenses arising from:
- Passenger misconduct
- Violation of these Terms
- Damage caused by Passenger
- Claims brought by members of Passenger's party
15. Force Majeure
The Company shall not be liable for failure or delay in performance caused by circumstances beyond reasonable control, including:
- Severe weather
- Natural disasters
- Terrorism
- Labor disputes
- Government restrictions
- Public emergencies
- Road closures
- Utility failures
16. Governing Law
These Terms shall be governed by the laws of the State of Utah.
Any dispute arising from these Terms or transportation services shall be brought exclusively in a court of competent jurisdiction located in Salt Lake County, Utah.
17. Attorney Fees
In any dispute arising under these Terms, the prevailing party shall be entitled to recover reasonable attorney fees, court costs, and related expenses.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms constitute the entire agreement between the parties concerning transportation services provided by Summit Slopes Transportation and supersede prior oral or written communications regarding such services.
20. Acceptance of Terms
By requesting, booking, purchasing, receiving, or utilizing transportation services from Summit Slopes Transportation, the Client and all passengers acknowledge and agree to these Terms and Conditions.
